Ratio decidendi

The rule this decision rests on

The Appellate Tribunal's jurisdiction to condone delay in filing an appeal under Section 61 of the Insolvency and Bankruptcy Code, 2016 is limited by the proviso to Section 61(2) to a further period of 15 days beyond the statutory limitation period, and it has no power to condone a delay exceeding that period.

1. This is an application praying for condonation of delay of 41 days in

refiling the appeal.

2. The ground taken in the Affidavit is that the Appeal was filed on

to arrange for the same and accordingly there was delay of 41 days.

Cause shown sufficient. 41 days in refiling delay is condoned.

the appeal.

2. The Order was passed on 05.12.2023 and this Appeal has been e-filed
