Matiullah vs State Of U.P. Thru. Prin. Secy. Home ...

Allahabad High Court6 May 2026

Ratio decidendi

The rule this decision rests on

An accused person charged under the Gangsters and Anti-Social Activities (Prevention) Act, 1986 may be granted bail where the court, considering the facts and circumstances of the case, the nature of the allegations, the period of incarceration, and the arguments of the parties, finds it to be a fit case for enlargement on bail, without regard to the merits of the case. A trial court may impose conditions on bail as it deems fit and proper in the interests of justice, and breach of bail conditions may be treated as abuse of the liberty of bail, subjecting the accused to further legal proceedings.
