Manoj Chandrakant Wadhavane vs Girish Sriram Juneja

National Company Law Appellate Tribunal7 March 2025Ashok Bhushan

Ratio decidendi

The rule this decision rests on

The Appellate Tribunal will not entertain an appeal against an interlocutory order by which the Adjudicating Authority has merely reserved its order after hearing the parties and directed the filing of written notes of arguments; such an order is not a determination that is appealable at that stage, and the contentions sought to be raised against it are not to be considered at the stage of reservation.
