Manba Investments & Securities Pvt. ... vs Sebi

Securities Appellate Tribunal4 October 2016J.P. Devadhar

Ratio decidendi

The rule this decision rests on

The impugned penalty order of the Adjudicating Officer dated April 25, 2014 is set aside as against the appellants, and the matter is restored to the Adjudicating Officer for a fresh decision on merits and in accordance with law, the basis being that the Adjudicating Officer had failed to consider the decision of SEBI in the Bajaj Group and Bachawat Group cases, the same ground on which the Tribunal had quashed the order against co-appellants in parallel appeals.
