Ratio decidendi

Where an accused has been in custody for a considerable period, has been enlarged on bail in related cases shown in a gang chart, and has a criminal history that is duly explained in the bail application and supporting affidavits, the court may grant bail under the Gangsters and Anti Social Activities (Prevention) Act, 1986, without expressing an opinion on the merits of the case, if it considers the case suitable for bail in the interest of justice.

Judgment
As delivered
2. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
3. The present bail application has been filed by accused-applicant seeking bail in FIR/Case Crime No.0837 of 2025, under Section 3(1) U.P. Gangsters & Anti Social Activities (Prevention) Act, 1986, Police Station- Purakalander, District- Ayodhya.
4. Learned counsel for the applicant submits that in the gang chart, four cases have been shown against the applicant. In all the cases, the applicant has been enlarged on bail. The bail orders are on record as Annexure Nos.3 to 6 to the affidavit filed in support of the bail application. Apart from the cases mentioned in the gang chart, the applicant has criminal history of 28 other cases which is duly explained in the bail application as well as in the supplementary affidavit. The applicant is in jail since 06.08.2025.
5. It is also submitted that the applicant is ready to furnish an undertaking in terms of requirement of Section 19(4)(b) of U.P. Gangsters & Anti Social Activities (Prevention) Act, 1986. It is further submitted that there is no possibility of the applicant of fleeing away from judicial custody or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail.
6. Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant.
7. On due consideration to the facts that the applicant is in jail since 06.08.2025; the applicant has been enlarged on bail in the cases shown in the gang chart; apart from the cases shown in the gang chart, criminal history of 28 cases is duly explained in bail application as well as in supplementary affidavit and without expressing any opinion on the merits of the case, I find it to be a fit case for enlarging the applicant on bail.
8. Accordingly, the bail application is allowed.
9. Let the applicant- Man Singh @ Raja Man Singh involved in the aforesaid case crime number be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions which are being imposed in the interest of justice:-

In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law.
