Mala Madhukar Parekh, Mumbai vs Assessee

Income Tax Appellate Tribunal12 January 2015

Ratio decidendi

The rule this decision rests on

The disallowance under section 14A read with Rule 8D cannot be sustained where the assessee has not claimed any expenditure in computing her income; section 14A operates only on expenditure that the assessee is entitled to claim, so in the absence of any such claim there is no expenditure capable of disallowance and the disallowance must be deleted.

Per Sanjay Garg, Judicial Member:

The present appeal has been preferred by the assessee against the order of ld. CIT(A) dated 01/01/2013. The issue involved in the present appeal is relating to disallowance made by the lower authorities u/s. 14A r.w.r. 8D of the Income tax Rules.

2 ITA No.2484/M/2013 2. At the outset the ld. AR of the assessee has submitted that the assessee in her computation of income had not claimed any expenditure. Hence, there was no question of disallowance of expenditure even u/s. 14A of the Act. We agree with the submissions of the ld. AR. The question of disallowance of expenditure will only arise, if an expenditure may be claimed by the assessee. Where no expenditure has been claimed under any head of income shown by the assessee earned from different sources, there cannot be question of disallowance of expenditure. Therefore, the disallowance made by the lower authorities u/s. 14A is ordered to be deleted.

3. In the result, appeal is allowed.
