M/S. Ultratech Cement Ltd vs Commissioner Of Central Excise, ...

Customs Excise and Service Tax Appellate Tribunal25 June 2015

Ratio decidendi

The rule this decision rests on

Tyres used on dumpers deployed in a captive mine for movement of goods qualify as cenvatable capital goods, and CENVAT credit on such tyres cannot be denied on the ground that their use lacks nexus with the manufacture of the final product, where the dumpers themselves are held to be cenvatable capital goods.

HON'BLE SHRI ARCHANA WADHWA, JUDICIAL MEMBER

Final Order No. 21432 / 2015

Per : ARCHANA WADHWA

On matter being called, neither anybody appeared nor is there any adjournment request. Accordingly, I have heard the learned DR and have gone through the impugned orders.

2. The appellants have been denied the CENVAT credit taken on tyres used for dumpers and demand to the extent of Rs.2.20 lakhs stands confirmed against the appellants on the ground that the said use cannot be held to be having any nexus with the manufacture of their final product.

3. I find that the Tribunal in the case of Commissioner of Central Excise, Hyderabad vs. India Cements Ltd.: 2009 (238) E.L.T. 193 (Tri.-Chennai) has held that dumpers used in the captive mines of the appellant for movement of the goods have to be held as cenvatable capital goods. By following the same, the tyres used in the said dumpers have to be held as cenvatable capital goods. By following the said decision, I set aside the impugned order and allow the appeal with consequential relief to the appellant.

(Order pronounced in open court)
