Per: P.K. Das

1. None appears on behalf of the Appellant. There is no application for adjournment in the record.

2. After hearing the learned Authorised Representative for the Revenue and on perusal of the records, we find that the issue involved in this case is disallowing the CENVAT Credit on the service tax paid on GTA service on outward transportation from the factory gate to the customers premises during the period January 2005 to July 2005. The Honble Karnataka High Court in the case of Commissioner of C.Ex. & S.T., LTU, Bangalore Vs ABB Limited 2011 (23) STR 97 (Kar.), held that the CENVAT Credit cannot be denied on outward transportation upto the Customers premises upto 01.08.2008.

3. In view of that, we find that the impugned order cannot be sustained. Accordingly, the impugned order is set aside and the appeal filed by the Appellant is allowed.
