- CitationExcise Appeal No. 55965 of 2013-Ex (SM)
Ratio decidendi
The rule this decision rests on
The Tribunal, following the Gujarat High Court's decision in Indsur Global Ltd. v. Union of India, holds that Rule 8(3A) of the Central Excise Rules, 2002 is ultra vires, so that a manufacturer may utilise Cenvat credit to discharge duty payable during the intervening period, notwithstanding the rule's bar on such utilisation. Where the assessee has correctly utilised Cenvat credit to pay duty, liability is confined to interest for the intervening period, and penalty under Rule 27 of the Central Excise Rules, 2002 is imposed only at a nominal sum of Rs. 5,000.

Per Ashok Jindal :
Heard the parties.
2. It is the case where the appellant defaulted in payment of duty in time. Later on, duty was paid by utilizing Cenvat credit. Revenues contention is that as the appellant has contravened the provision of Rule 8(3A) of Central Excise Rules, 2002. Therefore, they could not utilize the cenvat credit account for payment of duty during the intervening period and same is payable by them through PLA along with interest. In these circumstances, penalty was also imposed.
3. As the issue has been settled by Honble Gujarat High Court in the case of Indsur Global Ltd. vs. Union of India [2014 (310) ELT 833 (Guj)] wherein the Honble High Court has held that Rule 8 (3A) is ultra virus and cenvat credit can be utilized for payment of duty during intervening period. Therefore, I hold that appellant has correctly utilized the cenvat credit account for payment of duty. In these circumstances, the appellant is liable to pay interest for the intervening period and penalty of Rs.5,000/- is imposed under Rule 27 of the Central excise Rules, 2002. Interest and penalty shall be payable by the appellant within 30 days of communication of this order.
4. Appeal is disposed of in the above terms.
