M/S. Rohit Surfactants Pvt. Ltd vs C.C.E. & S.T. Bhopal
- CitationAppeal No. E/51202/2014-EX(SM)
Ratio decidendi
The rule this decision rests on
The entitlement to Cenvat credit on welding electrodes used in the fabrication of a storage tank and in the repair and maintenance of plant and machinery is governed by the High Court's decision in Sree Rayalaseema Hi-Strength Hypo Ltd. v. CCE Tirupati, which held that welding electrodes used in repairs and maintenance of plant and machinery qualify for Cenvat credit; the Tribunal, treating that question as settled by that binding authority, holds that such credit is available for electrodes used in fabrication of a storage tank and in repairs and maintenance thereon, and the impugned order denying it is set aside.

FINAL ORDER NO. 52072/2015-EX(SM)
Per Ashok Jindal:
The short issue involved in the matter is that whether the appellant is entitled to take Cenvat Credit on Welding Electrodes which have been used by the appellant in fabrication of storage of water tank as well as repairs and maintenance thereon or not.
2. The issue has been settled by the Honble High Court in the case of Sree Rayalaseema HI-Strength Hypo Ltd. Vs. CCE Tirupati-2012 (278) ELT 167 (AP), wherein it was held that Welding Electrodes used in repairs and maintenance of plant and machinery is entitled for Cenvat Credit. Therefore issue is no more res entigra. In these terms, I hold that appellant is entitled to take Cenvat Credit on Welding Electrodes which have been used for fabrication of storage tank and repairs and maintenance thereon.
3. In these terms, impugned order is set aside. Appeal is allowed with consequential relief if any.
