M/S. R.S. Ispat Pvt. Ltd vs Commr. Of C. Ex., Kolkata-Ii

Customs Excise and Service Tax Appellate Tribunal6 October 2015

Ratio decidendi

The rule this decision rests on

The Tribunal may not entertain an application for waiver of pre-deposit of a penalty under the second proviso to Section 35B(1) of the Central Excise Act, 1944, where the amount of penalty involved is less than Rs. 50,000, since clause (ii) of that proviso, under which such jurisdiction is invoked, is not attracted in that situation; the appeal and the stay application are accordingly dismissed.
