M/S. L.I.Digital Payments Pvt.Ltd vs Mr. Ishan Surenaer Bhandula

National Company Law Appellate Tribunal17 December 2021

Ratio decidendi

The rule this decision rests on

The appeal was held to be within limitation on the basis that the appeal was e-filed on the date recorded in the e-filing receipt, so the limitation ruling in the referenced Civil Appeal No. 3327 of 2021 did not apply; the court relied on the e-filing acknowledgment showing filing on 25.09.2021 against an impugned order dated 26.08.2021. Where the Adjudicating Authority rejected an application to recall an ex parte order so as to restore the corporate debtor's right to reply to a Section 9 application, and the record shows the applicant's counsel had complied with the directions for soft-copy service of the application, the Appellate Tribunal set aside the impugned order and restored the right to file a reply, subject to costs.
