M/S International Steel Corporation vs Commissioner Of Customs

Customs Excise and Service Tax Appellate Tribunal1 September 2015

Ratio decidendi

The rule this decision rests on

The fuel and oil contained in the bunker or engine room tanks of a vessel form an integral part of the vessel and are therefore classifiable under Heading 89.08 of the Customs Tariff Act, not under Heading 27.10; this follows the Gujarat High Court's decisions in Priya Holding and J M Industries, which the Tribunal treats as binding on the point.

Date of Hearing / Decision : 1/9/2015

ORDER No. A/11430-11435/2015 dtd 1/9/2015

Per : Mr.P.K. Das,

Common issue is involved in these appeals and therefore all are take-up together for disposal.

2. After hearing both the sides and on perusal of the records, we find that the appellants imported vessels for breaking purpose and classified under Heading No 89.08 of the Customs Tariff Act. Both the sides submit that the issue involved in this case is as to whether the Fuel and Oil containing in the engine room tank will be classifiable under CTH 89.08 or 27.10 of the Customs Tariff Act. The Honble Gujarat High Court in the case of M/s Priya Holding Pvt Ltd vs CC (Prev.) 2013(288)ELT.347 (Guj) held that the Fuel and Oil contains in the bunkers, that is, engine and the engine room tanks of the vessels form an integral part of the vessel and therefore it would be classifiable under Heading No. 89.08 of the Customs Tariff Act. The Honble Gujarat High Court in the case of CC vs. J M Industries 2014(302)ELT.382(Guj) on the same issue rejected the appeal filed by the Revenue.

3. In view of that, we hold that the Fuel and Oil Contained in the bunker/engine room tanks of the vessel, would be classifiable under Heading No. 89.08 of the Customs Tariff Act. All the appeals are disposed of in the above terms.
