M/S. Ideal Carpets Limited vs Sebi

Securities Appellate Tribunal10 July 2019Tarun Agarwala

Ratio decidendi

The rule this decision rests on

The Tribunal's disposal rests on the following reasoning: where the appellant has requested from the exchange a bifurcation of the annual listing fee claimed, and the exchange has not responded to that request, the exchange has no reason for failing to respond, and the matter is disposed of by directing the appellant to deposit the outstanding amount, with the exchange then obliged to furnish the requested bifurcation within a week of the deposit.

Per: Justice Tarun Agarwala (Oral)

1.

In view of the submission made by the learned counsel for

the respondent that Secretarial Audit Report has been submitted

to the respondent, the only question which remains is with

regard to the outstanding Annual Listing Fees of ` 14,49,630/-. 2

2. In this regard, we find that the appellant by an Email dated

November 01, 2018 had requested the respondent to provide the

bifurcation of the listing fee which apparently has not been

provided. We find that there is no reason for the respondent in

not responding to the Email of the appellant dated November

01, 2018.

3. We accordingly dispose of the matter, directing the

appellant to deposit the entire amount of ` 14,49,630/- within

two weeks from today. Once the amount is deposited by the

appellant the respondent will provide the necessary bifurcation

to the appellant within a week thereafter.
