M/S. Eicher Moters Limited vs Adesh Kaur & Ors
- CitationCompany Appeal (AT) No. 10 of 2017
Ratio decidendi
The rule this decision rests on
The Tribunal, while granting time to the respondents to take certain steps, made adverse observations against the appellant. The appellate tribunal holds that observations made in an interlocutory order which are not based on any record and which affect the rights of a party cannot stand, and that a Tribunal hearing a company petition must decide it on merits and must not be influenced by such observations. Where no application has been filed by any party seeking interim relief or directions from the Tribunal, and the Tribunal has not itself passed any specific direction or interim arrangement, the Tribunal may, in exercise of its jurisdiction, direct the regulator to take such steps as are available under law; but any such regulatory action must follow the principles of natural justice and the applicable statutory and regulatory requirements.
