- CitationCompany Appeal (AT) No. 40
Ratio decidendi
The rule this decision rests on
The Tribunal's power to direct inspection of company records under the Companies Act does not depend on a prior determination that the applicant is a director; the question whether the applicants are directors, and whether the company petitions are maintainable, is left to be decided by the Tribunal on the merits after hearing the parties, and is not decided on an appeal against an interlocutory inspection order. Where a Tribunal has been directed to decide company petitions within a statutory period and has not done so, the Tribunal is required to proceed to the merits of those petitions without granting further time for interlocutory steps such as inspection, and may direct the production of relevant records at that stage.
