Lora Mitra Rath vs Pradip Kumar Kar And Ors
- CitationCompany Appeal (AT) (Insolvency) No. 1350 of 2024
Ratio decidendi
The rule this decision rests on
The Adjudicating Authority may exclude from the period for implementation of an approved resolution plan the time during which the proceedings were pending before the Appellate Tribunal, where the financial creditors, having the requisite voting majority, have no objection to such exclusion and where the extension serves the object of resolving the corporate debtor rather than liquidating it. Where the Committee of Creditors has expressed its willingness to accept the balance amount under the resolution plan, the Tribunal may allow the resolution applicant to deposit that balance, and the Appellate Tribunal may set aside an order refusing extension of time for implementation on that basis, without deciding the other issues raised, in order to secure the revival of the corporate debtor.

No. 4532, 4876 of 2024 2 of 4 implementation period of the resolution plan is only in view of the fact that it would always be preferable to resolve the corporate debtor, as is the legislative intent. The answering respondent submits that it is in the interest of all financial creditors and other stakeholders of the corporate debtor that the CIRP culminates into resolution of the corporate debtor, instead of liquidation, as has been directed by the impugned order."
