Ligare Aviation Ltd vs Religare Enterprises Ltd
- CitationComp. App. (AT) (Ins.) No. 508 of 2022
Ratio decidendi
The rule this decision rests on
The Adjudicating Authority may not close the right of a party to file a reply, under the Insolvency and Bankruptcy Code proceedings, merely on the ground of prior adjournments where the record does not show that adjournments were granted at the party's request for the purpose of filing the reply, and where a reply-seeking application is pending and no short adjournment is granted; in such circumstances the closure of the right to reply is set aside and a short opportunity to file the reply is to be given, the Tribunal considering that a short time could have been allowed in the peculiar facts.

adjourned to 11.04.2022. Before that, on 08.04.2022, Application was filed
by the Appellant giving reason for seeking further time to file a reply. However,
