Kwality Catering Services vs Vineeta Maheshwari Resolution ...

National Company Law Appellate Tribunal1 June 2023Ashok Bhushan

Ratio decidendi

The rule this decision rests on

The Appellate Tribunal's order rests on the following reasoning: where an order has been passed ex parte against a party who says it was not served with the application, the appropriate remedy is to apply to the Adjudicating Authority under Rule 49 of the NCLT Rules, 2016 for recall of that order, and the Adjudicating Authority is to consider and decide such an application in accordance with law. Pending that application and the listed hearing, interim status quo may be maintained, and the Tribunal leaves all contentions of the parties open for determination before the Adjudicating Authority.

04.05.2023 passed by the Adjudicating Authority. Learned counsel for the

Appellant submits that by the said order the Adjudicating Authority has

directed the Appellant to evict from the license premises and to pay the

outstanding licensee dues. Learned counsel for the Appellant submits that

the said order has been passed ex-parte since the Appellant was not served

2. In view of the above, we are of the view that the remedy available to the

Appellant is to file an application under Rule 49 of the NCLT Rules, 2016

are of the view that if such application is filed by the Appellant, the same shall

be considered and decided by the Adjudicating Authority in accordance with

law.

may be issued regarding inspection of the premises. It shall be open for the
