Ratio decidendi
The rule this decision rests on
The Tribunal, on a stay application against a tax demand, grants stay of the disputed demand where the Assessing Officer has attached the assessee's bank accounts and recovery would cause the assessee hardship affecting business and day-to-day life, having regard to the assessee's arguable case; the stay is made conditional on a part-deposit of the demand and on compliance with a hearing schedule, failing which the stay stands vacated.
