Kamall Ahuja vs Jagtar Singh & Sons Hydraulics Private ...

National Company Law Appellate Tribunal18 March 2025Ashok Bhushan

Ratio decidendi

The rule this decision rests on

The period of limitation for an appeal under the Insolvency and Bankruptcy Code runs from the date of the impugned order, and an application for recall of a different order, rejected later on a different ground, does not extend that period by way of exclusion under Section 14 of the Limitation Act, 1963. The Appellate Tribunal's power to condone delay in filing an appeal is confined by the proviso to Section 61(2) of the Insolvency and Bankruptcy Code to a maximum of fifteen days; where an appeal is filed beyond that condonable period, the delay application must be dismissed and the appeal consequently dismissed.
