Jm Financial Asset Reconstruction ... vs Ask Trusteeship Services Private ...
- CitationComp. App. (AT) (Ins.) No. 912 of 2024
Ratio decidendi
The rule this decision rests on
The Tribunal held that, where a real estate project's RERA registration has lapsed and the RERA-mandated restriction on withdrawals from the project's separate account is therefore engaged, the funds accumulated in that account from allottee collections, which are earmarked for construction, may nonetheless be released for construction purposes if the ends of justice so require, in order to protect the interests of the homebuyers in a corporate-insolvency process concerning a real estate company.

3. Applicant who is an IRP submits that in pursuance of the order of this

account of which the Respondent No.3 has put a debit freeze. We had issued
notice in the application and reply has been filed by Kotak Mahindra Bank.
4. Counsel for the Respondent has referred to Practice Directions which
was issued by RERA Authority namely-- "The Uttar Pradesh Real Estate
