Jayram vs State Of U.P.

Allahabad High Court6 May 2026

Ratio decidendi

The rule this decision rests on

Where an accused person applies for bail under the Bharatiya Nyaya Sanhita, and considering the nature of the accusations, the severity of punishment upon conviction, the nature of supporting evidence, the reasonable apprehension of witness tampering, and whether a prima facie case exists, a case for bail may be made out even without commenting on the merits of the case, warranting the grant of bail subject to conditions. An accused granted bail may be released on executing a personal bond with two reliable sureties in an amount determined to the satisfaction of the court, and the court retains the liberty to cancel bail upon breach of any conditions imposed.

Learned counsel for the applicant further submits that the FIR has been registered against four unknown persons. He submits that in the FIR only general allegation has been levelled against the unknown accused persons. He submits that the applicant is not named in the FIR and his name surfaced during the course of investigation in the statement of co-accused. He submits that no incriminating material has been recovered from the possession of the applicant. He submits that there is no independent witness of the alleged incident. He submits that in the present case, charge-sheet has been filed on 30.03.2026, as such the applicant is not required for any custodial interrogation. Considering all those facts and circumstances, the nature of accusations, severity of the punishment in the case of conviction and nature of supporting evidence, reasonable apprehension of tampering with the witness and prima-facie case, but without commenting on merit of case, a case for bail is made out.

Accordingly, the bail application is allowed.

1. The applicant will not tamper with the evidence.
