Jayesh Vinodrai Valia vs Canara Bank & Ors
- CitationComp. App. (AT) (Ins) No. 909 of 2026
Ratio decidendi
The rule this decision rests on
The Appellate Tribunal's order rests on the following principle: a Section 95 application for initiating insolvency against a personal guarantor must be supported by a valid invocation of the guarantee, and an appointment of a Resolution Professional made without an examination of whether the guarantee was validly invoked cannot stand. The Tribunal set aside the appointment order and remanded for a fresh decision in accordance with law, expressly without expressing any opinion on the merits.
