Ratio decidendi
The rule this decision rests on
Where a party seeks to rely on a compromise in criminal proceedings for offences of theft and dishonesty, the trial court must issue notice to all signatories to the compromise requiring their personal presence, and thereafter verify the compromise in their presence before accepting it as part of the record. A compromise in such criminal proceedings cannot be accepted without such verification by the court. The trial court is the appropriate forum to ascertain and verify whether the parties have in fact compromised the matter, and such verification must precede any consideration of the compromise's legal effect.
