Indian Overseas Bank vs Parekh Aluminex Ltd (Through Its Rp) & ...

National Company Law Appellate Tribunal6 November 2019

Ratio decidendi

The rule this decision rests on

The Adjudicating Authority, having been approached against an order of adjournment in a corporate insolvency resolution process where the statutory period is about to expire, is directed to decide promptly whether to accept or reject the resolution plan and to decide the resolution applicant's pending application for withdrawal of that plan, rather than deferring the matter; where a time-bound insolvency process is nearing its statutory limit, the Adjudicating Authority must determine the resolution plan and any pending withdrawal application expeditiously, and the appellate remedy is exercised by remitting the matter with such directions.
