In the matter of WDB Medical Data India Private Limited
- CitationCP (IB) No. 35/BB/2025
Ratio decidendi
The rule this decision rests on
The Tribunal may dissolve a company under Section 59(8) of the Insolvency and Bankruptcy Code, 2016 once it is satisfied, on the material before it, that the affairs of the company under voluntary liquidation have been completely wound up and its assets entirely liquidated. Where the Tribunal so satisfies itself, the dissolution is made by an order allowing the petition under Section 59(7), and the dissolution does not operate to absolve the company or its directors of any financial or criminal liability arising from the conduct of the company's affairs, including in the petition and in affidavits or undertakings furnished on its behalf.
