In the matter of Vishaali S,

National Company Law Tribunal28 June 2024

Ratio decidendi

The rule this decision rests on

The Tribunal's reasoning on the face of this order rests on the following points, which are the only ratios the text supports: Section 94(1) of the Insolvency and Bankruptcy Code, 2016 permits a personal guarantor to make an application for initiation of the Insolvency Resolution Process to the Adjudicating Authority, and the application is properly before the Tribunal where the personal guarantor has filed it under that provision and Rule 6 of the Personal Guarantors Rules, 2019. Where the personal guarantor has served a copy of the application on every financial creditor and the corporate debtor for whom he or she stands as guarantor, as required by Rule 6(2), the procedural precondition of service is satisfied. The Adjudicating Authority is entitled to appoint a resolution professional, drawn from the panel recommended by the Insolvency and Bankruptcy Board of India and holding a subsisting authorisation for assignment, to examine the application under Section 97(6) and to report within the period prescribed by Section 99(1), notwithstanding that the applicant proposed a different resolution professional.
