In the matter of Vinay Wire and Poly Products Pvt. Ltd.
- CitationIA No. 378-2023 in CP (IB) No.359-ALD-2019
Ratio decidendi
The rule this decision rests on
The Tribunal allowed withdrawal under section 12A of the Insolvency and Bankruptcy Code, 2016 of a section 9 petition admitted before a claim by a financial creditor had been received and a committee of creditors constituted, where the withdrawal was not approved by the financial creditor in the manner the Tribunal had directed, the financial creditor's email response being treated as sufficient consent to withdrawal. Where a financial creditor has submitted a claim, and the constitution of a committee of creditors has been triggered, an application for withdrawal of a corporate insolvency resolution process petition is not a simpliciter section 12A application and requires the response of the financial creditor to be sought and obtained before the Tribunal can permit withdrawal.
