The rule this decision rests on
The Adjudicating Authority may, on an application by the Resolution Professional, permit withdrawal of a Section 9 petition at the stage of corporate insolvency resolution process where the Committee of Creditors has authorised the withdrawal by a resolution passed with one hundred per cent voting share, the matter having been settled between the parties outside the court, and such withdrawal is to be granted in accordance with Section 12A of the Insolvency and Bankruptcy Code, 2016 read with Regulation 30A of the IBBI (Insolvency Resolution Process for Corporate Persons) Regulations, 2016. Upon permitting such withdrawal, the petition is dismissed as withdrawn, the moratorium under Section 14 ceases to have effect, the Resolution Professional stands discharged, management of the corporate debtor reverts to its Board of Directors, and pending applications are dismissed as infructuous.
