Ratio decidendi

The rule this decision rests on

Where a repayment plan in a personal insolvency under Part III of the Insolvency and Bankruptcy Code, 2016 has been approved by creditors holding at least seventy-five per cent of the voting share under Section 111, and the Resolution Professional has recommended its acceptance, the Adjudicating Authority is bound to approve the repayment plan under Section 114(1), and has no discretion to refuse it once those two conditions are satisfied.
