In the matter of THIRANI INDUSTRIES LIMITED

National Company Law Tribunal1 June 2026

Ratio decidendi

The rule this decision rests on

The Tribunal holds that where the Appellate Tribunal has set aside an order rejecting a Section 9 application and allowed the appeal, the application, having been filed for initiation of CIRP, stands admitted by operation of that appellate order, and the Adjudicating Authority is consequently bound to initiate CIRP, declare the moratorium under Section 14, and appoint an interim resolution professional in accordance with the Code's provisions.
