National Company Law Tribunal21 June 2022

Ratio decidendi

The rule this decision rests on

The Adjudicating Authority may order liquidation under Section 33 of the Insolvency and Bankruptcy Code, 2016 where the resolution professional's application shows that the corporate debtor is not a going concern, holds no movable or immovable property, and has no realisable assets beyond recoverable debts whose recovery has proved unsuccessful, such that there is no prospect of a resolution plan being received within the statutory period. Where the Committee of Creditors has approved the filing of a liquidation application and the proposed liquidator named by the resolution professional is suspended by the Insolvency and Bankruptcy Board of India, the Adjudicating Authority may appoint a liquidator from the panel approved by the Board.
