Ratio decidendi
The rule this decision rests on
The Tribunal holds that an acknowledgment of a debt made before the expiry of the limitation period, and a subsequent written agreement to pay it, bring the claim within the limitation period under Section 18 of the Limitation Act, 1963 read with Section 25(3) of the Indian Contract Act, 1872, so that the operational debt is not time-barred and the application under Section 9 of the Insolvency and Bankruptcy Code, 2016 is not barred by limitation. Where an operational debt has been confirmed in writing by the corporate debtor and the debt is shown to be in default on the basis of the ledger and the demand notice, the Tribunal is satisfied of the existence of a default and admits the application under Section 9 of the Insolvency and Bankruptcy Code, 2016, appointing an interim resolution professional and invoking the moratorium under Section 14.
