In the matter of Supereco Automotive Co. Llp
- CitationIA(IBC)/286(MP)2025 in CP(IB)/10(MP)2024
Ratio decidendi
The rule this decision rests on
The Tribunal permitted withdrawal of a Section 9 application and set aside the admission order where the operational creditor and the suspended management of the corporate debtor had executed a settlement agreement before the Committee of Creditors was constituted, the operational creditor had filed a withdrawal in Form FA, and the cost of the resolution process had been paid, with the Resolution Professional confirming that nothing remained to be recovered; the Tribunal treated the pre-constitution stage of the process as the decisive factor permitting withdrawal and release of the corporate debtor from the process.
