In the matter of SHRUTHI MILK PRODUCTS PRIVATE LIMITED

National Company Law Tribunal3 July 2026

Ratio decidendi

The rule this decision rests on

The Adjudicating Authority may order liquidation of a corporate debtor under Section 33 of the Insolvency and Bankruptcy Code, 2016 where the Committee of Creditors has, with the requisite voting share, resolved to liquidate, and the record shows that no resolution plan compliant with Sections 30(2) and 31 of the Code could be placed before the CoC because the resolution applicant failed, despite repeated deficiency communications and extensions, to furnish mandatory documents including proof of financial capability and complete disclosures relating to personal guarantors.
