In the matter of Shree Shyam Bearings Pvt. Ltd.
- CitationC.P (IB) No.71/KB/2024
Ratio decidendi
The rule this decision rests on
The Adjudicating Authority is satisfied, on the basis of the loan agreement, bank statements, disbursement proof and the Corporate Debtor's letters requesting disbursal, that a debt exists and that the Corporate Debtor has defaulted in repaying it; the default is therefore established and an application under Section 7 of the Insolvency and Bankruptcy Code, 2016 may be admitted where the default is shown on the record. Where the Corporate Debtor has admitted its default in its reply affidavit, that admission is itself a basis on which the Adjudicating Authority may find default established for admission under Section 7. An application under Section 7 is within the period of limitation where the date of default falls within the statutory period before filing, and the Adjudicating Authority may so find on the material placed before it.
