In the matter of SHREE BADRI KEDAR UDYOG PRIVATE LIMITED

National Company Law Tribunal13 October 2026

Ratio decidendi

The rule this decision rests on

Where the Committee of Creditors has, by a resolution passed with the requisite voting share under Section 33 of the Insolvency and Bankruptcy Code, 2016, approved liquidation of the corporate debtor, and the Resolution Professional has applied on that basis, the Adjudicating Authority may order liquidation under Section 33(1) of the Code, there being no statutory impediment to doing so. Where the Committee of Creditors has not recommended an insolvency professional for appointment as liquidator, the Adjudicating Authority may itself appoint a liquidator under Section 34(1) of the Code, subject to the appointee holding a valid Authorisation for Assignment from an Insolvency Professional Agency. Where the Liquidation Process Regulations have been substituted and the amended regulation states that its requirements apply only to liquidation processes commencing on or after the date of the amending regulations' commencement, the liquidator's fee is to be determined under the amended regulation, not the superseded one.
