Ratio decidendi
The rule this decision rests on
The Tribunal allows the Liquidator's application and closes the liquidation on the footing that the Corporate Debtor has been revived under an approved scheme of compromise or arrangement, so that the liquidation process under Regulation 44(1) of the Liquidation Process Regulations has no further purpose and the Liquidator may be discharged on procedural compliance. Pending proceedings by or against a Corporate Debtor whose liquidation is closed on revival under an approved scheme do not abate on closure; the Corporate Debtor, not the liquidation, remains the party to them, and the successful scheme proponent may pursue such litigation before the appropriate forum.
