In the matter of Shivris Resources Private Limited

National Company Law Tribunal8 May 2024

Ratio decidendi

The rule this decision rests on

The Tribunal may, by a clarificatory order, correct an inadvertent error in its earlier admission order and substitute the Interim Resolution Professional whose name the financial creditor had actually proposed in the petition and whose Form 2 consent was on record, where the error was a mismatch between the petition's proposed name and the name appointed in the order. Upon such correction, the earlier-appointed Interim Resolution Professional stands discharged under the Code once he has handed over the records and information to the incoming Interim Resolution Professional, and the incoming Interim Resolution Professional is charged with the duties under sections 15, 17 to 21 of the Insolvency and Bankruptcy Code, 2016, and with completing the corporate insolvency resolution process within the statutory period.
