- CitationI.A. 577 of 2023 in C.P.(IB) No. 2534 of 2019
Ratio decidendi
The rule this decision rests on
The Tribunal may, under Section 60(5) of the Insolvency and Bankruptcy Code, 2016, read with Rule 44(2) of the IBBI (Liquidation Process) Regulations, 2016, extend the period for completing a corporate liquidation where the liquidator shows that the remaining realisation of assets (including sale of residual immovable property, plant, machinery, furniture and investments) cannot be completed within the existing period, and the Tribunal finds such extension just and proper in the circumstances. A delay in filing an application for such extension may be condoned where the Tribunal is satisfied with the explanation for the delay, and the liquidator is thereafter bound to complete the remaining tasks in accordance with the model timelines prescribed under the Liquidation Process Regulations.
