Ratio decidendi
The rule this decision rests on
Where a resolution professional, at any time during the corporate insolvency resolution process and before confirmation of a resolution plan, intimates the Tribunal of a decision of the committee of creditors approved by not less than sixty-six per cent of the voting share to liquidate the corporate debtor, the Tribunal is bound to pass a liquidation order under Section 33(2) of the Insolvency and Bankruptcy Code, 2016, and the application is to be allowed on that basis.
