- CitationI.A. No. 3590 of 2023 in C.P. (IB) No. 1140-MB-IV-2020
Ratio decidendi
The rule this decision rests on
A Resolution Professional may decline to admit a claim that cannot be verified with reference to the evidence presented and the Corporate Debtor's books of accounts, and an applicant who seeks to have such a rejected claim admitted must place evidence before the Adjudicating Authority sufficient to displace the Resolution Professional's decision. The Adjudicating Authority is not a fact-finding authority for determining the claims of creditors, and where the claimant has produced no documentary evidence beyond what is contradicted by the financial records, such as the absence of TDS reflection on interest income in audited statements from a given year, an application to admit the disputed component of the claim must fail.
