In the matter of Sangeeta Ajay Goenka vs. Union Bank of India & Others

National Company Law Tribunal12 June 2024

Ratio decidendi

The rule this decision rests on

The Tribunal's directions are procedural; the order rests on the following principle: where a personal guarantor's application under Section 94 of the Insolvency and Bankruptcy Code, 2016 is filed with the requisite affidavit under Section 94(4) and (5), the defences raised by creditors on notice are not determined at the stage of appointment of a Resolution Professional but are to be considered when the Resolution Professional's report is filed and the matter is taken up for admission or rejection under Section 100. A Resolution Professional may be appointed in respect of a personal guarantor, and the same insolvency professional may be appointed in both the corporate insolvency process and the insolvency and bankruptcy proceeding of the personal guarantor to the corporate debtor, the restriction on such dual appointment having been removed by the amended Regulations and the IBBI circular dated 3 February 2024.
