In the matter of Sampurna Suppliers Private Limited
- CitationIA No. 1155 of 2023 in C.P. (IB) No. 2046-KB-2019
Ratio decidendi
The rule this decision rests on
The Tribunal may order liquidation of a corporate debtor under Section 33(2) of the Insolvency and Bankruptcy Code, 2016, where the Committee of Creditors has approved liquidation and the Tribunal is satisfied that all procedural formalities under the Code and the CIRP Regulations have been complied with by the Resolution Professional, and that the decision to seek liquidation followed from the absence of any Expression of Interest from substantial bidders despite efforts to revive the company through a resolution plan. Where the Resolution Professional has consented to act as Liquidator but the Insolvency and Bankruptcy Board of India has directed that a liquidator other than the IRP or RP be appointed under Section 34(4)(b), the Tribunal will appoint a liquidator other than the erstwhile RP under Section 34(1), subject to that person holding a valid Authorisation for Assignment from the Insolvency Professional Agency of which he is a member.
