Ratio decidendi
The rule this decision rests on
The Tribunal's reasoning rests on the following points, which I extract only where the text states them as grounds for the order: The Tribunal holds that where no resolution plan has been approved by the Committee of Creditors and the time for the corporate insolvency resolution process has ended, the corporate debtor is required to be liquidated in the manner laid down in the Insolvency and Bankruptcy Code, 2016, and an application under Section 33 for liquidation is to be allowed on that footing (paragraphs 14 and 16). The Tribunal holds that a Resolution Professional who has consented to act as liquidator may nonetheless be displaced, the appointment of a liquidator other than the IRP/RP being made under Section 34(4)(b) of the Code in light of the IBBI circular dated 18.07.2023 (paragraph 17). The Tribunal holds that the appointment of a liquidator is subject to the appointee holding a valid Authorisation for Assignment issued by her Insolvency Professional Agency under Regulation 7A of the IBBI (Insolvency Professionals) Regulations, 2019 (paragraph 18(ii)).
