- CitationI.A. No. 760/2019 in C.P (IB)No. 539/9/HDB/2018
Ratio decidendi
The rule this decision rests on
The Tribunal's reasoning rests on the following principles, in the order the order takes them: Where the Adjudicating Authority, before the expiry of the insolvency resolution process period (or the maximum period permitted for completion of the corporate insolvency resolution process), does not receive a resolution plan under sub-section (6) of Section 30, or rejects the resolution plan under Section 31 for non-compliance with its requirements, Section 33(1) requires it to pass an order that the corporate debtor be liquidated; where no resolution plan has been submitted within the insolvency resolution period, the Tribunal has no alternative but to make a liquidation order under Section 33(1)(a). Under Section 34(1), upon the making of a liquidation order, the resolution professional appointed for the corporate insolvency resolution process shall act as liquidator for conducting the liquidation process, and the Tribunal may appoint that person as liquidator where she has consented to act.
