In the matter of Priknit Retails Limited

National Company Law Tribunal11 September 2019

Ratio decidendi

The rule this decision rests on

A financial creditor's application under Section 7 of the Insolvency and Bankruptcy Code, 2016 may be admitted where the Adjudicating Authority is satisfied that a default has occurred, the application is complete, and there are no disciplinary proceedings pending against the proposed interim resolution professional; the occurrence of default may be established by the financial creditor's records, including certified statements of account, charge verification reports, balance sheet entries and a recovery certificate. The fact that the financial creditor earlier obtained a consent decree or recovery proceedings jointly with other lenders does not bar the financial creditor from separately initiating corporate insolvency resolution proceedings under the Code, so long as the corporate debtor continues to default in payment of the debt owed to that creditor.
