In the matter of Phonic Online Private Limited

National Company Law Tribunal11 January 2024

Ratio decidendi

The rule this decision rests on

The Tribunal admitted a voluntary application under Section 10 of the Insolvency and Bankruptcy Code, 2016 for initiation of the Corporate Insolvency Resolution Process once it was satisfied that the corporate applicant had made out a case for initiation under that section, the application being supported by a board resolution recording that the company could not repay its debts and by the written consent of the proposed interim resolution professional in Form-2 together with his registration certificate. On admission, the moratorium under Section 14 of the Code is declared, and its prohibitions operate upon the corporate debtor as stated in Section 14(1)(a) to (d), with the exceptions recognised by the provisions the order identifies: transactions notified by the Central Government, supply of essential goods or services, and non-application to a surety in a contract of guarantee under Section 14(3)(b).
