National Company Law Tribunal20 May 2020

Ratio decidendi

The rule this decision rests on

The Tribunal holds that a statute is presumed to be prospective unless it is held to be retrospective, either expressly or by necessary implication; and that where an amendment raising the minimum default threshold under Section 4 of the Insolvency and Bankruptcy Code, 2016 (by proviso) contains no words making it retrospective, it applies prospectively and does not affect an application already pending for admission at the time of the amendment. The Tribunal holds that an operational creditor's Section 9 application is to be admitted where the application is complete under Section 9(2) and (3) (proof of default, no payment of the unpaid operational debt, service of demand notice with invoice, no pre-existing dispute, and the required affidavit, bank statement and proposed Interim Resolution Professional without disciplinary proceedings), and the corporate debtor has neither replied to the demand notice nor raised any dispute other than a request for time to settle.
